1. Acceptance of Terms

By creating an account or using the TenRands application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

TenRands is a personal finance management tool that aggregates financial data and uses Artificial Intelligence (AI) to provide insights, coaching, and "arguments" regarding spending habits.

3. Financial Disclaimer (Crucial)

TenRands is for informational and educational purposes only.

Not Financial Advice: The insights, calculations, and AI responses provided by TenRands do not constitute professional financial, investment, legal, or tax advice.

No Fiduciary Duty: We are not a registered Financial Services Provider (FSP) under the Financial Sector Conduct Authority (FSCA) in South Africa.

User Responsibility: You are solely responsible for your financial decisions. Always consult with a qualified professional before making significant financial decisions.

4. AI Limitations (Artificial Intelligence)

The Service utilizes Large Language Models (LLMs) like Google Gemini. By using the Service, you acknowledge:

  • Accuracy: AI can "hallucinate" or generate incorrect information. You should verify all numbers, interest rate calculations, and advice independently.
  • Context: The AI only knows what you tell it or what is uploaded. It does not have a complete picture of your life or legal situation.

5. User Accounts

You are responsible for safeguarding the password that you use to access the Service. You agree not to disclose your password to any third party. You must provide accurate and complete information when creating an account.

6. User Content & Data Ownership

  • Ownership: You retain ownership of the bank statements and financial data you upload.
  • License: You grant TenRands a worldwide, non-exclusive license to use, reproduce, and process your User Content solely for the purpose of providing the Service to you (e.g., parsing PDFs, generating charts).
  • Prohibited Content: You may not upload forged documents, illegal content, or files containing viruses.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of TenRands and its licensors.

8. Limitation of Liability

To the maximum extent permitted by applicable law (including the Consumer Protection Act of South Africa): In no event shall TenRands, its directors, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service. We generally do not accept liability for financial losses incurred based on advice or data presented in the app.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

11. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of significant changes via the email address associated with your account.
